These Terms of Sale ("Terms") apply to all purchases of subscription services offered by My Musical Room through our website. By purchasing a subscription, you agree to be bound by these Terms.

These Terms supplement our Terms of Service and Privacy Policy, which also apply to your use of our platform.

2. Products and Services

2.1 Available Subscriptions

We offer the following subscription plans:

Free Tier

  • 3 music pages maximum
  • Limited resource uploads
  • Basic practice tracking

Price: €0.00/month

Studio Plan

  • Unlimited music pages
  • Unlimited resource uploads
  • Advanced analytics and insights
  • Priority customer support

Price: €4.99/month or €49.99/year

2.2 Service Features

Detailed information about features included in each subscription tier is available on our pricing page. We reserve the right to modify features with reasonable notice.

3. Pricing and Payment

3.1 Pricing

  • All prices are displayed in Euros (€) and include applicable taxes
  • Annual subscriptions offer a discount compared to monthly billing
  • Prices may change with 30 days' notice to existing subscribers
  • New prices apply immediately to new subscriptions

3.2 Payment Methods

We accept the following payment methods:

  • Credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • SEPA Direct Debit (where available)
  • PayPal (where available)

3.3 Payment Processing

All payments are processed securely through Stripe, our payment processor. We do not store your payment information on our servers.

  • Payment is charged immediately upon subscription activation
  • Recurring payments are charged on the same date each billing cycle
  • Failed payments may result in service suspension
  • You are responsible for maintaining valid payment information

4. Subscription Management

4.1 Subscription Activation

Your subscription becomes active immediately upon successful payment. You will receive a confirmation email with your subscription details.

4.2 Billing Cycles

  • Monthly Subscriptions: Billed every 30 days from the start date
  • Annual Subscriptions: Billed once per year from the start date
  • Billing dates are based on your subscription start date
  • You will receive email notifications before each billing cycle

4.3 Subscription Changes

You can upgrade or downgrade your subscription at any time through your account settings. Changes take effect at the next billing cycle unless otherwise specified.

4.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation takes effect at the end of your current billing period.

  • You will retain access to premium features until the end of your billing period
  • No partial refunds are provided for unused time
  • Your account will revert to the free tier after cancellation
  • Some data may be deleted according to our data retention policy

5. Right of Withdrawal (EU Customers)

5.1 Withdrawal Period

As an EU customer, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason.

5.2 Withdrawal Process

To exercise your right of withdrawal, you must inform us of your decision by sending an email to contact@mymusicalroom.com or using the withdrawal form available on our website.

5.3 Effect of Withdrawal

If you withdraw from your subscription:

  • We will reimburse all payments received from you within 14 days
  • We will use the same means of payment as you used for the original transaction
  • Your account will revert to the free tier
  • You will not incur any fees as a result of the reimbursement

5.4 Exceptions

The right of withdrawal does not apply if you have begun using the service and have given your explicit consent to start the service before the withdrawal period expires.

6. Refunds

6.1 General Refund Policy

All sales are final. Refunds are generally not provided except in the following circumstances:

  • Exercise of right of withdrawal within the applicable period
  • Technical issues preventing service access
  • Billing errors on our part
  • Legal requirements in your jurisdiction

6.2 Refund Process

To request a refund, contact our customer support team at contact@mymusicalroom.com with your account details and reason for the request.

6.3 Refund Timeline

Approved refunds will be processed within 5-10 business days and may take additional time to appear on your payment method depending on your bank or card issuer.

7. Service Availability

We strive to maintain 99.9% uptime for our service, but cannot guarantee uninterrupted access. Service interruptions may occur due to:

  • Scheduled maintenance (with advance notice when possible)
  • Technical issues or system failures
  • Third-party service outages
  • Force majeure events

Extended service interruptions may result in service credits or refunds at our discretion.

8. Limitation of Liability

Our liability for any damages arising from your subscription is limited to the amount you paid for the subscription in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities.

This limitation does not affect your statutory rights as a consumer.

9. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, or internet or telecommunications failures.

10. Dispute Resolution

10.1 Consumer Disputes (EU)

EU consumers may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/ to resolve disputes.

10.2 Governing Law

These Terms are governed by French law. Any disputes shall be subject to the exclusive jurisdiction of the French courts.

10.3 Alternative Dispute Resolution

We encourage resolving disputes through direct communication. If that fails, we may participate in alternative dispute resolution procedures as required by applicable consumer protection laws.

11. Changes to Terms

We may modify these Terms of Sale at any time. Material changes will be communicated to subscribers via email with at least 30 days' notice.

Your continued use of the service after changes constitutes acceptance of the modified Terms.
